These Terms and Conditions (“Terms”) govern the use of the website and services provided by Financial Protection Services, LLC (“FPS,” “we,” “us,” or “our”). By accessing our site or using our document preparation software, you agree to be bound by these Terms.
1. Professional Licensing & Agency Disclosures (Arizona Specific)
FPS is owned and operated by individuals holding professional licenses in the State of Arizona. Please review the following mandatory disclosures:

Real Estate & Mortgage Disclosure: One or more principals of FPS are licensed by the Arizona Department of Real Estate (ADRE) and the Arizona Department of Insurance and Financial Institutions (DIFI).

Affiliated Business Arrangement (ABA): You are hereby notified that a conflict of interest may exist between the owner’s capacity as a licensed Realtor/Mortgage Officer and their ownership in FPS. You are in no way required to use FPS services as a condition of any real estate or mortgage transaction.

No Dual Agency: Engagement with FPS for estate planning software or "Privacy Trust" documents does not create a real estate agency or mortgage brokerage relationship. No fiduciary duties associated with those licenses extend to the services provided by FPS.

Certified Franchise Executive (CFE) Status: While a principal may hold the CFE designation from the International Franchise Association (IFA), this service does not provide franchise brokerage, legal franchise disclosure document (FDD) reviews, or investment advice.
2. No Attorney-Client Relationship
FPS IS NOT A LAW FIRM.

The legal documents provided are licensed from Estate Documents Pro, LLC and are attorney-drafted templates.

Your use of this site does not create an attorney-client relationship.

FPS does not provide legal or tax advice. We do not review your answers for legal sufficiency, draw legal conclusions, or apply the law to the facts of your specific situation.
3. Use of Self-Help Software

Accuracy: You are solely responsible for the accuracy of the information you enter into the software.

State Specificity: While our documents are designed to be compliant with Arizona law (A.R.S. Title 14), estate laws vary. You are encouraged to have your final documents reviewed by an attorney licensed in your jurisdiction.

Personal Property Memorandum: Any memorandum created must be incorporated by reference in your Trust to be legally binding under A.R.S. § 14-2513.
4. Limitation of Liability
To the maximum extent permitted by Arizona law, FPS and its licensed principals shall not be liable for any indirect, incidental, or consequential damages arising from your use of the documents. Our total liability shall not exceed the amount paid by you for the service.
5. Governing Law & Venue
These Terms are governed by the laws of the State of Arizona. Any legal action or proceeding relating to your access to, or use of, the site shall be instituted in a state or federal court in Maricopa County, Arizona.
6. Fee Disclosure
FPS charges flat fees for software access and document preparation. These fees are separate and distinct from any commissions or loan origination fees earned by principals in their capacities as Realtors or Mortgage Officers.
